1.1 Welcome to DesignBrit, a design service that offers both subscription-based and one-off payment services to our valued clients. By using our services, you agree to comply with the following terms and conditions.
2. Subscription Services
2.1 Subscription Plans: DesignBrit offers various subscription plans that provide clients with access to design services on a recurring basis. Clients can choose the plan that best suits their needs.
2.2 Payment: Clients are required to pay the subscription fee in advance for the chosen plan. Payments will be automatically deducted on a recurring basis unless the client cancels their subscription.
2.3 Cancellation: Clients can cancel their subscription at any time by contacting DesignBrit or from their members area.
3. One-Off Payment Services
3.1 Service Offerings: In addition to subscription services, DesignBrit also offers certain design services on a one-off payment basis. Clients can choose these services as needed without committing to a subscription.
3.2 Payment: Clients are required to make full payment for one-off services before work commences. DesignBrit will only start work once payment has been received in full.
3.3. DesignBrit will provide a quote for the one-off service based on the client's requirements, and additional charges may apply for revisions or additional work.
4. Refunds
4.1. Due to the high-quality nature of the work, no refunds will be issued.
5. Intellectual Property
5.1 Ownership: All designs created by DesignBrit, whether through subscription or one-off services, are the intellectual property of DesignBrit until full payment has been received from the client.
5.2 Usage Rights: Upon full payment, clients will have the rights to use the designs for their intended purposes. DesignBrit retains the right to showcase the work in its portfolio unless otherwise agreed upon with the client.
5.3. Clients may not reproduce, distribute, or resell any design work created by DesignBrit without prior written consent.
6. Confidentiality
6.1 Non-Disclosure: DesignBrit agrees to keep all client information confidential and will not disclose any sensitive information to third parties without prior consent from the client.
6.2 Data Protection: DesignBrit complies with all relevant data protection laws and regulations to ensure the security and confidentiality of client data.
6.3. Clients are also expected to keep all communications with DesignBrit confidential.
6.4. Clients are responsible for providing accurate and up-to-date information to DesignBrit and ensuring that all necessary permissions have been obtained for any third-party materials used in their designs.
7. Limitation of Liability
7.1 Indemnity: DesignBrit shall not be liable for any loss or damage incurred by the client as a result of using our services, except in cases of wilful misconduct or gross negligence on our part.
7.2 Maximum Liability: In no event shall DesignBrit's liability exceed the total amount paid by the client for the specific service in question.
8. Amendments and Termination
8.1 Changes: DesignBrit reserves the right to amend these terms and conditions at any time, with prior notice to clients.
8.2 Termination: DesignBrit reserves the right to terminate services for clients who violate these terms and conditions or engage in any unlawful activities.
8.3 Clients may cancel their subscription at any time by providing written notice to DesignBrit or from their members area.
8.4. DesignBrit reserves the right to terminate services if a client breaches these Terms and Conditions or engages in any unlawful activities.
8.5 Upon termination of services, clients will no longer have access to design tools or resources provided by DesignBrit.
9. Governing Law
9.1 Jurisdiction: These terms and conditions shall be governed by and construed in accordance with English law. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the English courts.
